“With landlord-tenant courts overwhelmed with pre-pandemic docket backlog and ample new pandemic related proceedings, landlords should consider being pragmatic to resolve minor or rent related issues with struggling tenants. While property owners will have their day in Court eventually, summary proceedings and evictions will likely be significantly delayed in 2021 and tenants have been afforded new protections due to the pandemic. It may be more practical and cost effective to negotiate a lease amendment or a surrender agreement than to litigate. If a situation is dire or the property needs to be protected from harm or waste, consult with an attorney about what injunctive relief, if any, you may be entitled to obtain in Supreme Court.”
