Pedram A. Tabibi is a Partner in the firm’s Litigation, Social Media, Software & Privacy Practice Groups. He has been a member of the Social Media, Privacy and Software Practice Group, one of the firm’s fastest growing areas, since its inception. Pedram is a frequent commentator on social media, privacy and technology issues, having made over 50 television appearances, including on Fox 5 News and PIX11 News. Pedram’s experience in the fields of social media law, intellectual property law and internet law includes privacy and publicity rights on Facebook, discovery in litigation involving Facebook, LinkedIn and Twitter, drafting official rules for contests and for sweepstakes including contests on Instagram, defamation on social media and in online reviews, cyber-squatting, trademark and copyright infringement. Pedram’s experience also includes notice and takedown letters under the Digital Millennium Copyright Act, search engine keyword disputes involving Google AdWords and other search engines, domain name disputes and utilizing influencers while complying with the Federal Trade Commission’s guides for the use of endorsements and testimonials in advertising.
Pedram also has drafted a variety of agreements relating to websites, social media, software, the cloud and apps, including website development agreements, website purchase agreements, website terms of sale and terms of service, software development agreements, software as a service agreements, subscription agreements and agreements involving source code escrow. Pedram’s privacy law experience includes advising clients on the privacy implications of their online and social media use, including drafting privacy policies involving online and social media presence and business practices. Pedram has also drafted agreements involving data privacy, including agreements involving the General Data Protection Regulation.
Pedram is an experienced litigator, having litigated claims involving breach of contract, breach of non-competition and non-solicitation agreements, unfair competition, copyright and trademark infringement, the Computer Fraud and Abuse Act and Electronic Communications Privacy Act, false advertising under the Lanham Act, breach of fiduciary duty, partnership and corporate disputes and real property and air rights disputes. Pedram has also been involved in arbitrations, including participating in multiple hearings conducted before three member arbitration panels.
Pedram is an Adjunct Professor of Law at St. John’s University School of Law where he teaches a course on Social Media and the Law. Pedram became one of the area’s first dedicated social media law professors.
Pedram previously was a judicial intern with the Hon. Martin E. Ritholtz of the Queens County Supreme Court, and a legal intern with Forbes.com.
In addition to Pedram’s television appearances, Pedram has been a speaker on topics including social media, intellectual property, privacy and publicity rights, attorney marketing and more, including at the Social Media Strategies Summit, the Long Island Digital Summit, Trade Brooklyn and Trade Nassau, the Blog World and New Media Expo at the Jacob Javits Center, the Ohio Northern University College of Law Symposium and the Benjamin N. Cardozo School of Law.
Pedram was honored as one of Long Island’s “30 Under 30” young professionals by the Huntington Chamber of Commerce for 2012 and as one of The Jewish Week’s “36 Under 36” in 2013.
